Did You Know….Juries Never Hear the Word “Insurance” in an Injury Trial?

I hate to admit it, but every once in a while those big billboard lawyers have a good point in their barrage of TV commercials that they seem to pop out like toast. A recent one has a lawyer saying a jury will never hear about the existence of car insurance in a car crash trial as they deliberate about injuries and damages. It’s true. Mostly. When we file suit for our client, the defendant is always the other driver and car owner. It’s almost Read More +

My Big Case Against Walt Disney World

“What? You sued Disney?!?” I wonder when I’m asked that if it’s a judgment against suing “the happiest place on Earth”, or if it’s more of wonderment for taking on the Goliath of Florida. For most people, it’s a little bit of both. At my old law firm we had a client with a legitimate claim against Disney World for injuries sustained at Magic Kingdom. A Primer on Defamation: I’ve Been Defamed, What Are My Rights?

Every so often I get a call from a potential client who wants to litigate against someone for “defaming” them. The caller is generally spitting mad and wants blood. This is usually in the context where the client was the subject of some rant by some aggrieved party where he or she gets cursed at in front of a bunch of others. Think of the homeowner’s association meeting or the school board meeting where somebody stands up and starts swearing up and down that you’re Read More +

Yes, Defective Airbags Are Still Being Sold in New Cars

As incredible as it may seem, the Japanese company Takata cannot keep up with replacing defective airbags that have killed 13 people so far worldwide. Even more incredibly, these airbags, known to be defective, are still being installed in new cars as of June, 2016. This is according to a June 1 New York Times article. If you’re in the market for a new Toyota, Volkswagen, Fiat Chrysler or Mitsubishi, you may be buying a car with a bad airbag. How bad is it? When Read More +
