A: Damages are really measured in two ways for personal injuries. The first is pain and suffering, which is really up to a jury to assess. The other are the economic damages. The lost wages, the loss of profits, any medical bills that have to be paid, any health insurance companies that have to be paid back. Those two measures are sort of added together and you’re really relying on the attorney’s experience to put a number on it to make a claim to the insurance company so that you can negotiate towards something which is fair for both the insurance company but more importantly your client.
