A: Yes, even though you’re a passenger in a car that caused the car accident, you can still make a claim against the driver. ‘Cause you were not at fault, you’re a passenger in the car and theoretically you’re seatbelted in. And if the other driver was at fault, there’s no prohibition for making a claim against the at-fault driver, even though it was somebody sitting right next to you.
