The majority of times your case will settle without having to file suit. I would say 60 or 65 percent of the time your case will resolve just between the attorney and the insurance company, and that smaller percentage of time, a lawsuit may need to be filed, but for most clients, unless the case is worth a lot of money or the case is very shaky liability, most insurance companies would rather settle the case. It’s only when the case has larger value or the insurance company is being unreasonable that a lawsuit needs to be filed so I would go with the odds on this one.
