A: Not wearing a seatbelt is not a bar to making your recovery for permanent injury. However, if there is an injury that would have been or could have been avoided if you were wearing your seatbelt, then the jury has a right to reduce some of the recovery based on that injury that could have been avoided had you been wearing the seatbelt, but not wearing a seatbelt is not a bar to recover.
