A: For those who choose, when they win the lottery especially when it’s a long number, they can just take it annually. It can be paid out to them for so long as they live and so long as that prize is still in existence. If something happens to that winner, it would go to their heirs. Most people, and I mean the vast majority of people, choose the cash option. When you take the cash option, it does reduce the amount of your prize, but most people would rather take their prize and invest it themselves than wait for it comes on an annual basis from the Florida lottery.

A: Florida statutes define a permanent injury as death, physical scarring, and pain and suffering in general and most clients end up in the pain and suffering category in general which can be anything related to the neck and back or joints or knee pain, shoulder pain, things like that. Even headaches, even things you can’t necessarily determine on an x-ray, but it takes a doctor, whether it’s a chiropractor or an orthopedist or a neurologist to state that the patient does, in fact, have a permanent injury and sometimes that does require six months of treatment due to the AMA Guides evaluation of permanent impairment.

A: Most of the time when you’re in an accident, you do want to let your car insurance company know especially if you’re going to be treating for any injuries or to get some basic treatment, especially if your car is damaged and you may have to have your car fixes. It’s always a good idea to contact your car insurance company, and sometimes they’ll let you know if there are no injuries or if the other insurance company is going to pay for the damage to your car, they’ll let you know. You don’t really need to make a claim.

A: This all falls into the heading of preserving the evidence. And some people, when they fall, get embarrassed and pick themselves up and leave, never the right thing to do. If you’ve fallen, you need to determine what you fell on. And this may require taking out your cellphone and taking some photos of the area where you fell. If you were seen by a witness, definitely secure the name and contact information for that witness. Always, especially if an injury is determined, always report your fall to the property owner; whether it’s a restaurant, or a mall, or a store, in general. You want them to have something, an incident report, on file to document the fact that you were there, and that you fell, and that you sustained injury.
